1. Acceptance of Terms

By accessing Enclave Systems, you agree to be bound by these corporate terms of service.

2. Smart Classification Technology & Advisory Limitations

WARNING: Enclave Systems uses Artificial Intelligence (AI) and machine learning models to perform Smart Classification — predictive document analysis. ALL CLASSIFICATION OUTPUTS ARE STRICTLY ADVISORY. AI models are fallible and can produce incorrect results, incorrect confidence scores, or misclassified documents. Enclave Systems assumes absolutely no liability for infrastructure damage, financial loss, or safety incidents resulting from any unverified Smart Classification output.

3. Mandatory Human-in-the-Loop (HITL) Verification

The Customer is legally required to verify all Smart Classification outputs via the HITL Dashboard. An authorised human auditor must explicitly "Approve & Sign" every classification. The platform enforces independence levels (I1/I2/I3) per EN 50128 §5.3.3 — self-approval is blocked at SIL 3 and SIL 4. This human sign-off transfers compliance liability strictly to the Customer and the verifying Auditor.

4. CENELEC Standards Coverage

This platform serves as a tool to aid Railway RAMS (Reliability, Availability, Maintainability and Safety) engineers. It does not automatically grant certification under any of these standards. The cryptographic audit trail proves the human verification process took place; independently assessed compliance requires engagement with a recognised assessment body.

5. Hazard Log, Compliance Checklist & Safety Management Tools

The Hazard Log, Compliance Checklist, Project management, and Audit History features are tools to assist safety practitioners. Entries in the Hazard Log do not constitute a complete or independently assessed safety case. Compliance checklist results represent the auditor's assessment at a point in time. Enclave Systems assumes no liability for decisions made on the basis of records created, updated, or closed within these features.

6. Data Retention & Deletion

Records including documents, projects, hazards, compliance checks, consultation requests, and audit trails are retained for the duration of your active subscription. Audit trails are append-only and cannot be deleted while a subscription is active, as they form part of the evidential record. Upon account deletion or subscription termination, all organisational data is removed within 30 days, subject to any legal retention obligations communicated in writing.

7. Third-Party Frameworks & User Liability

Customers are solely responsible for ensuring they possess the appropriate licensing (such as a single-user license for individual practitioners, or a network/multi-user license for team-wide access) from their standardization body before entering proprietary data into the workspace. Enclave Systems operates strictly as a workflow tool and is not liable for any copyright infringement, intellectual property disputes, or licensing issues linked to the CENELEC norm or any other standard provided by the customer.

8. Foundation Models & Copyright Burden

Enclave Systems relies on the fact that third-party LLM foundation models (like Gemini and Claude) shoulder the copyright burden of their training data, not Enclave Systems. The customer assumes all responsibility for the IP and copyright of the data they upload.
